Faction Shut Downs

The LSPD and SASD are able to shut down an illegal faction after gathering enough information on it and its members through investigations. Once a faction was shut down by in character means it ceases to exist for a certain amount of time. Official factions also lose their status as a result of successful shut downs.

Relevant In Character Evidence/Information

Enough information and evidence must have been gathered against the faction that the LSPD and/or SASD wish to attempt shutting down before requesting approval for the attempt start. The way this information is considered relevant for the approval depends on the circumstances, such as the way the faction in question operates and how it's structured.

In general, however, the main focus of the LSPD or SASD should be to figure out how the faction they wish to shut down runs, what it does and what it's members do in connection to the faction, in character. That means that in the usual case, members breaking the law individually are less relevant than members breaking the law in connection to the faction.

The seriousness of crimes that have been or are being committed by the faction or its members are relevant for whether an attempt is approved or not as well. Less serious crimes such as infractions and misdemeanors are a lot less relevant than felonies, though some charges like 'evading' are usually considered less serious as well.
Out of Character 'Proof' for Evidence/Information

All information (evidence, names of members) gathered by the LSPD or SASD require an out of character attachment written in double brackets with information on how, when and by whom it was gathered unless the in character evidence can serve as out of character proof (i.e. chatlogs, screenshots of interrogations)

If a non-LSPD/SASD member (an informant) provided information on members of an illegal faction and/or crimes done by them, the name of the informant has to be included OOC together with screenshots of full chatlogs with supporting screenshots. In addition, the person has to be asked how he/she found out about the information and he/she has to provide screenshots (or similar) proving he/she actually received the information if deemed necessary.

Information that does not add up or is otherwise random without the guidelines being fulfilled are not being paid attention to when a faction shut down attempt is requested and reviewed by the Head of Factions.
Requesting Approval

At any point the LSPD or SASD feel that they have gathered enough information and evidence against an illegal faction they can request approval for a faction shut down attempt to the Head of Factions. A lot of important information (see 'Relevant In Character Evidence/Information') that are properly backed up out of character (see 'Out of Character 'Proof' for Evidence/Information') are expected from the police faction's side in order to get the approval.

Before requesting approval of a faction shut down attempt it may also help taking a look at the requirements for succeeding an ongoing faction shut down attempt found below to make sure that you can easily fulfill them as by the information and evidence you have at hand, in character.

When forwarding a request, please include all available information and evidence, most preferably the entire casefile that was put together with the required out of character information. However, please make sure everything is organized and structured properly so that we can see where provided information belongs and when/by whom it was received. The PM should also clearly show a list of all members with outstanding charges with every charge linked to the correspondending evidence bits.

After forwarding a request, please wait for a response patiently. We understand that you wish to start the attempt as soon as possible but it may take a little while to go through all provided information before being able to make a decision. You may be asked to gather more information or to fix certain bits if necessary.
Individual Faction Member Take Outs*

The LSPD and SASD are able to request permission to attempt taking out* individual members of factions from the Head of Factions in exceptional cases while no shut down attempt is active. If such a request is approved and the police successfully manages to take out* the member in question, the person may not use his or her character fully for X days or weeks (decided by the Head of Factions). In that time, the character of the member may not be used if it was taken out via kill or only used in LSP if it was taken out via arrest.

An attempt to take out an individual faction member is only considered for approval if a lot of evidence that proves he or she is continually committing serious crimes and/or frequently arrested for such serious crimes without changing his or her way of acting in character as a result. The availability of this type of attempt is hence thought to ensure faction members take the in character consequences of serious crimes and lengthy prison sentences more serious and allow the LSPD/SASD to take out specific members only rather than taking out an entire faction.

Once an attempt was approved it's active until the member in question was taken out*. As already mentioned, however, these attempts are not supposed to be frequent and instead, for exceptional cases because the way shut down attempts work under the current guidelines doesn't allow a faction to be shut down as a result of only one individual constantly stepping out of line.

* A member is - for this part of the guidelines - 'taken out' if he/she was either arrested or killed while attempted to be arrested by the LSPD/SASD in regards to the active individual member take out attempt. The LSPD/SASD must actually attempt arresting insiders of the illegal faction, meaning that they may only shoot to kill them if absolutely justified by in character reasons.

Killing Detectives

If an illegal faction that is being investigated on finds out about the ongoing investigations as well as the detective behind them in character and then kills the detective as a result, the killed character may not be used to continue investigations on the illegal faction in question for one month. The detective's knowledge/memory of the illegal faction is fully wiped as well (PK). The player whose detective character was killed may not use a different character to continue said investigations during the given month.

For a detective kill to be valid, these guidelines must be followed by the killing party:
The illegal faction executing the kill must ask for permission from Head of Factions beforehand and provide proof and details backed up with screenshots of how they got to know that the detective being killed was investigating on their group in character. If they were told by a non-faction member in character, that person will also have to deliver proof of how he/she received that information. Gathered proof has to be forwarded to the Head of Factions for review if the killed detective requests it.
If no proof showing that the faction found out about the detective in question being onto them in character is given OR the faction didn't actually know the detective they went after was investigating on them in character, the permanent PK doesn't apply and he/she may resume working on the casefile right away.
Faction Roster

Leaders of all factions whether unofficial or official are expected to keep track of all their members at all times. For this, seperating between outsiders who are not inducted in to the activities of the faction and insiders who are inducted in to the activities of the faction is important as in the usual case, only inducted members of factions are relevant for faction shut down attempts.

Official factions should try to have all their insiders invited to their faction OOC (via /invite) at all times, regardless of their rank or position - however, this isn't a requirement. Both, unofficial and official factions must be able to provide an up to date member roster of their faction upon request of the Head of Factions.

Providing Information to Head of Factions

The Head of Factions and Factions Management require some information from the attempt requester of the LSPD/SASD after the attempt was approved. Not all factions possess a thread in the Faction's Forum that show all information clearly, and not all forwarded requests necessary include information on detectives involved on the case.

Due to that, the LSPD/SASD member who forwarded the approved request must provide the current in-game and forum name of the leader of the faction that is attempted to be shut down as well as a list of all detectives actively working on the case on the faction that is attempted to be shut down (seperated between 'main' and 'assisting' detectives).

The attempt does not officially start until all information (from both, police faction and illegal faction) were provided. Once all information were forwarded, the Head of Factions informs both parties that the attempt is starting.

Providing Information to Head of Factions

When a faction shut down attempt request was approved and the LSPD and/or SASD forwarded the in-game and forum name of the current leader of the illegal faction in question, the Head of Factions contacts the faction leader and requests an up to date member roster that shows all current faction insiders (see 'Faction Roster' under 'Prior to Faction Shut Down Attempt').

For faction shut down attempts each player in the faction that is being worked against may only have one active character on the forwarded faction's member roster. Additional characters of the same player in the faction may not be on the forwarded faction member roster! The roster is being double checked by the Head of Factions to ensure each character is 'owned' by a seperate player.

Should the forwarded faction member roster include more than one character for specific players, all characters of that player on the roster will be classed as 'taken out' which is equal to arrested or killed by the LSPD/SASD in regards to the ongoing faction shut down attempt. Inactive members who are not invited in-game are merely removed and excluded as leaders can't always see whether a member is currently active or not; inactive members who are invited but on the list are counted as taken out.

Breach of Regulations/Guidelines

If the police faction behind the faction shut down attempt violates a regulation/guideline that affects the ongoing attempt the attempt is declared unsuccessful and a new faction shut down attempt request may not be forwarded for a period of time defined by the Head of Factions based on the seriousness of the violation.

The action taken against a violating faction may not always turn out to be as described above. It all depends on the type of violation and how much it's relevant to the ongoing attempt. The Head of Factions/Factions Management may decide to keep an attempt active if the circumstances allow it to.

Note: Please keep in mind that action can not simply be taken based on the word of someone. The wrongdoing needs to be confirmed, either directly by proof or by the Head of Factions/Factions Management witnessing it. But remember: some actions can't easily be proven or witnessed, so please bear with us!
Succeeding an Attempt

The main task of police factions during ongoing faction shut down attempts is to imprison suspects for outstanding, major charges that are relevant to the faction (see 'Relevant In Character Evidence/Information' under 'Prior to Faction Shut Down Attempt') in order to cripple the faction from an in character point of view. However, other actions against the faction that shut down its activities in some way in character such as shutting down a weapon or drug storage (weapon factory/drug store) are relevant as well, depending on the type of faction.

While, as mentioned, other actions against the faction play a role, a certain amount of members must be taken out* in order for an attempt to be called successful by the Head of Factions/Factions Management. In the usual case the minimum amount of members that needs to be taken out* are around 50%-60% of all members on the forwarded member roster of the faction that is being worked against. If higher ranked members or even leaders are taken out*, however, the percentage of members required to be arrested may lower depending on the way the faction operates, but wouldn't go lower than 30% in any case. Keep in mind that irrelevant outsiders aren't necessarily paid attention to.

If the police has taken out* enough members based on the information above they may request that the ongoing attempt is declared successful. All actions taken against the faction (illegal properties shut down, which members were taken out*, etc) during the faction shut down attempt must be listed. The Head of Factions then decides whether the attempt should be declared successful or if more actions should be taken against the faction before declaring the attempt successful.

The LSPD or SASD have 14 days to take enough action against the faction they are working on. If they fail to successfully request declaring the attempt successful within that time, the attempt failed (see 'Unsuccessful Attempt' under 'Aftermath of Faction Shut Down Attempt').

Remember: It all depends on the faction and other circumstances, so just because 50% of all faction insiders were taken out* it doesn't mean that the attempt is successful!

Breach of Regulations/Guidelines

If the illegal faction that is being attempted to be shut down violates a regulation/guideline that affects the ongoing attempt the faction shut down attempt is declared successful. Depending on the seriousness of the violation the faction may be partly or completely shut down for a period of time defined by the Head of Factions.

The action taken against a violating faction may not always turn out to be as described above. It all depends on the type of violation and how much it's relevant to the ongoing attempt. The Head of Factions/Factions Management may decide to keep an attempt active if the circumstances allow it to.

It is the responsibility of the faction leader of the illegal faction that is being worked against to make sure his/her members refrain from metagaming and continue as usual before finding out about what is happening in character, should they find out in character.

Frozen Faction Member Roster

Once a faction shut down attempt was approved and started the illegal faction that is being attempted to be shut down may no longer recruit new members. In addition, players may not 'exchange' their characters (e.g. role playing to leave the state on one character and returning on another) while the attempt is active.
Taken Out Faction Members

Members of a faction that is being worked against during an ongoing shut down attempt who have been taken out* by the LSPD/SASD may not use their taken out* character fully until the end of the attempt.

If a character was taken out* via kill, via inactivity or via 'leaving state' method it may not be used to role play anything in any way related to the faction (the one being attempted to be shut down) they are in until the attempt is over. If a character was taken out* via arrest it may only be used inside Los Santos Prison until the attempt is over.

Whether or not they may continue using the character in question after the attempt ended depends on whether the attempt was successful or not (see 'Aftermath of Faction Shut Down Attempt').

The LSPD and or SASD have 14 days to take enough action against the faction they are working on. If they fail to successfully request declaring the attempt successful within that time, the attempt failed (see 'Unsuccessful Attempt' under 'Aftermath of Faction Shut Down Attempt').
Aftermath of Faction Shut Down Attempt

Unsuccessful Attempt

If a faction shut down attempt was unsuccessful, the LSPD/SASD may not request attempting to shut down the same faction for at least two months. Members of the faction that still have outstanding charges in relation to the previous attempt may still be arrested, however, they are then counted as normal arrests. Members that were taken out* during the attempt may be used again if an attempt was declared unsuccessful.

* A member is 'taken out' if he/she was either arrested, killed while attempted to be arrested by the LSPD/SASD in regards to the active shut down attempt, left town/the state in character, went inactive after the start of the attempt or got character killed. The LSPD/SASD must actually attempt arresting insiders of the illegal faction, meaning that they may only shoot to kill them if absolutely justified by in character reasons.
Successful Attempt

If a faction attempt was successful, factions (official and unofficial) forcefully cease to exist for 4 weeks with official factions also losing their official status. During that amount of time the characters that were taken out* during the attempt may not be used freely (see below) and the faction may not continue operating as the faction they were operating as prior to the success of the attempt.

If a character was taken out* via kill, via inactivity or via 'leaving state' method it may not be used until the shut down time is up. If a character was taken out* via arrest it may only be used inside SACF until the shut down time is up. Once the time is up taken out* characters may be used freely again and the faction may 'restart' as the faction they were prior to the successful attempt if its leadership wishes to.
