SENATE BILL N° 004-19



An act to re-establish the University of Los Santos as a private-public institution, and declare such institution to be of national importance and provide for its incorporation and for matters connected therewith or incidental thereto.


THE PEOPLE OF THE STATE OF SAN ANDREAS DO ORDAIN AS FOLLOWS:

  • Section 1. SHORT TITLE
    1. This Act may be cited as the "Higher Education Act of 2019".
    Section 2. DECLARATIONS
    1. The University of Los Santos shall be declared a public-private institution, with the State Government funding fifty (50) percent of its expenses.
    2. It shall come into force, by notification, to establish the Department of Education, and to nominate and appoint the State Superintendent of Education , whom will oversee the operation of the Education Department.
    3. Officials of the Board of Education and/or the Department of Education shall be nominated and appointed by the State Government, and confirmed by the Senate's Standing Committee on Commerce, Science, Transportation, Education and Health. Professors and other teaching staff may be appointed by the institution at their own discretion.
    Section 3. DEFINITIONS
    1. "Institution" means the University of Los Santos.
    2. "Board" means the Board of Education tasked with overseeing the daily operation of the University of Los Santos.
    3. "President" means the elected head of the Board of Education, selected and appointed by the Standing Committee on Commerce, Science, Transportation, Education and Health.
    4. "Fund" means a sum of money provided to cover the institution's expenses and to ensure its continuous operation.
    Section 4. INCORPORATION
    1. The University of Los Santos shall be a corporate body having perpetual succession and a common seal with power within its jurisdiction, subject to the provisions of this Act, to acquire, hold and dispose of property and to contract, and shall, by that name, sue and be sued.
    Section 5. DEPARTMENT OF EDUCATION
    1. There shall be constituted by the State Government of San Andreas, for the purposes of this Act, a Department to be known as the Department of Education, consisting of the following member(s), namely:—
      1. the State Superintendent of Education to be nominated by the State Government, and confirmed by the Standing Committee on Commerce, Science, Transportation, Education and Health, provided by the Rules of the Senate.
    2. The Department of Education shall perform the following function(s), namely:—
      1. to ensure equal access to education and to promote educational excellence;
      2. to ensure equal opportunities to participate for all eligible students, teachers, and other program beneficiaries in any project or activity carried out under an applicable program;
      3. to promote the ability of such students, teachers, and beneficiaries to meet high standards;
      4. responsible for the overall direction, supervision, and coordination of all activities of the Department and to serve an advisor to the Governor's Office on policies, programs and activities related to education in the State of San Andreas.
    Section 6. BOARD OF EDUCATION
    1. The Board shall perform the following function(s), namely:—
      1. nurture and promote equality and excellence in education and research;
      2. provide for programmes and courses of instruction and research leading to the award of the Bacherlors, Masters and Doctoral degrees in social sciences, arts, management and technology
      3. grant, subject to such conditions as the institution may determine, degrees, diplomas, certificates or other academic distinctions or titles at various academic levels to candidates who have attained the prescribed standard of proficiency as judged on the basis of examination or on any other basis of testing and evaluation and to withdraw any such degrees, diplomas, certificates or other academic distinctions or titles for good and sufficient reasons;
      4. confer honorary degrees or other distinctions and to institute and award fellowships, scholarships, exhibitions, prizes and medals;
      5. lay down standards of admission to the institution through an examination or other method of testing and evaluations
      6. manage the content, quality, design and continuous evaluation of its academic and research programmes in a manner that earns accreditation of a great stature;
      7. promote research and development for the benefit of public industries/sectors through the integration of teaching and research;
      8. cooperate with educational and research institutions in any part of the State similar to those of the institution by exchange of teachers, scholars, researchers, conduct of join research, undertaking sponsored research and consultancy project, etc;
      9. establish, maintain and manage halls and residences for students to lay down conditions for such residences;
      10. supervise, control and regulate the discipline of all categories of employees
        of the institution and to make arrangements for promoting their health and general welfare;
      11. receive gifts, grants, donations or benefactions from the State Government or from any other person or organisation.
    Section 7. ADMITTANCE AND TEACHING
    1. The institution shall be open to persons of either sex and of whatever race, creed, caste or class, and no test or condition shall be imposed as to religious belief or profession in admitting students, appointing teachers or employees or in any other connection whatsoever.
    2. All teaching and other academic activities at the institution shall be conducted by or in the name of the institution in accordance with the Statutes and the Ordinances made in this behalf.
    Section 8. RELEVANT AUTHORITIES
    1. The following shall be the relevant authorities of the institution, namely:—
      1. the Department of Education;
      2. the Board of Education (President, Dean, Vice Dean, Secretary);
      3. the Senate (Standing Committee on Commerce, Science, Transportation, Education and Health);
      4. such other authorities as may be declared by the current authorities of the institution.
      Section 9. GRANTS AND FUNDS OF THE INSTITUTION
      1. For the purpose of enabling the institution to discharge its functions efficiently under this Act, the State Government may, after due appropriations made by the relevant committee(s) in the Senate, pay to the institution fifty percent of its expenses, or exceed that much when and if it deems fit.
      2. The institution shall maintain a fund to which shall be credited:—
        1. all fees provided by the State Government;
        2. all fees and charges provided by other persons or organisations;
        3. all fees received by the institution by way of grants, gifts, donations, benefactions, bequests or transfers; and
        4. all fees received by the institution in any other manner or from any other source.
      Section 10. DEGREES AND SPONSORED SCHEMES
      1. The institution shall have the power to grant degrees and other academic distinctions and titles under this Act.
      2. Whenever the institution receives funds from the State Government, any other agencies, organisations or persons, such funds shall be used to sponsor schemes in coalition with other firms, agencies and research institutes.
