TITLE 15. Amendments & Additions (PC15-01 to PC15-13)

  1. At the pleasure of the Governor and/or State Senate, amendments, additions, and revisions to this penal code may be made at any time with respect to the due process of the legislative process of those authorities.
  2. The Chief Justice may also review the Penal Code and make proposed changes to ensure its effectiveness and appropriate language for legal interpretation. Major changes should be consulted upon with the Governor and/or State Senate.
  3. General policy and procedure changes will be made in Title 12. Code Policy. All other changes shall be made within relevant Titles.
  4. At least seven days shall be given between the release of an updated Penal Code revision and its implementation.
  5. All changes to this code shall be dated and acknowledged in Title 15. Amendments & Additions
(15)01. May 25 2015
  1. Final Draft of Penal Code issued. All charges rewritten and adapted to incorporate more effective, accurate language. Examples added to commonly confused charges and to help describe appropriate charge usage. Precedents added to create official policy on wiretapping, exigent circumstances, and other policies. General cleaning and reorganization of code entries for effectiveness.

  1. Final Draft of Penal Code 2016 with thanks to everyone who sent suggestions and feedback.
  2. Clarified (4)02 to clarify arrests should only be made when it is clearly known and agreed by the officer who issued the fine, or a command ranking officer, that the arrest should take place.
  3. Added a Tinted Windows citation in the road law since it seems sufficiently RPed again (though no word if this is regulated by management) to justify front window tinting citations.
  4. Split DUI into DUI and DWI to clarify felony and misdemeanor violations.
  5. Torture is now Mayhem as that language better fits the circumstances of what mayhem is. Added a small addition to clarify non-permanent harm that is akin to torture.
  6. Clarified license suspension to expire when an officer’s suspension period is lifted, even if an individual goes and gets a new script-wise license at the DMV.
  7. Three strike rule for license suspension expanded from 12 hours to 36 hours.
  8. Aggravated battery is now a felony
  9. Maximum fine per road law incident raised from $10,000 to $25,000
  10. Evading altered to significantly increase the penalty for fleeing police, renamed to eluding
  11. Increased almost all fines on the penal code by between $1,000 and $2,000

  13. (4)12. Resisting A Peace Officer made to be an Officer Discretion Charge.

  1. Final Draft of Penal Code 2016 re-issued. All amendment made prior to this date has been logged correctly.

  3. Increased the third offense to (4)17 Misuse of a Government Hotline imprisonment time.
  4. Added (12)16 Criminal Fines, (12)17 Repeat Offender Clause, and (12)18 Immunity.
  5. Added enhancement to the (8)02 Eluding a Peace Officer for high-performance or oversized vehicle usage while evading.
  6. Altered (12)12 Maximum Imprisonment to include an exception in line with (12)17 Repeat Offender Clause.
  7. Added (6)12 Possession of Marijuana
  8. Added new point to (6)01 Possession of Controlled Substance to specify Marijuana possession.
  9. Removed (13)01 Racketeering.

  1. (4)02. Failure to Pay a Fine reverted to its previous version with minor changes to provide more clarity.
  2. (11)12. Registration Violation updated to include failure to display a license plate.

  4. (1)01. Intimidation — re-written for clarification, consolidated.
  5. (1)06. Aggravated Battery — inclusion of weapon clause, maximum time increased to 240 minutes.
  6. (1)13. Vehicular Murder — point 1 re-written for clarification.
     
  7. (2)02. Trespassing — clarified ownership of trailer parks/caravans in "NOTES".
  8. (2)03. Trespassing within a Restricted Zone — re-written, zones defined, changed to misdemeanor of 30-50 mins.
  9. (2)04. Burglary — addition of crime not being stackable with (2)02. Trespassing.
  10. (2)05. Possession Of Burglary Tools — re-written for clarification, items defined.
  11. (2)07. Armed Robbery — number 2 edited to not be stackable with (2)06. Robbery.
     
  12. (3)03. Prostitution — re-written and re-defined for clarification, lowered from 90-150 minutes to 60-120 minutes.
  13. Addition of (3)04. Solicitation of Prostitution — standalone charge for those who pay for prostitution services.
  14. (3)05. Pandering / Pimping — punishment raised from 60-120 minutes to 90-180 minutes.
  15. (3)08. Statutory Rape — age of consent for San Andreas changed to 18.
     
  16. (4)02. Failure To Pay A Fine — note about warrants re-written to include Sergeant or above.
  17. (4)03. Contempt of Court*** — removal of officer discretion on this charge.
  18. (4)13. Escape From Custody — (( note about administrators issuing this charge added. ))
  19. (4)17. Misuse Of A Government Hotline — changed to a misdemeanor punishable by 10-20 minutes.

  49. (11)11. Driving Under The Influence (DUI) — removed clause about government employees, redundant (due to govt. cooperation act).
  50. (11)15. Driving without a Valid License — minimum age to drive in San Andreas defined as 16. (( See OOC NOTES about /licenses. ))
  51. (11)18. Tinted Windows — re-written and re-defined.
  52. Addition of (11)20. Fire Hydrant Parking Restriction — infraction of $5,000 and vehicle impoundment.
     
  53. (12)08. Suspicion Policy — maximum detainment of a suspect changed from 30 minutes to 60 minutes.
  54. (12)17. Repeat Offender Clause — re-written and re-defined, especially parties who may issue the clause.
  55. Addition of permanent vehicle seizure to (12)17. Repeat Offender Clause with judge's order.
