SAN ANDREAS ELECTORAL CODE

WHITESPACE
TITLE 1. PRELIMINARY PROVISIONS
E.C. (1)01.
  1. The San Andreas Electoral Bureau is recognized as the primary authority presiding over the fair enforcement of the San Andreas Electoral Code. The Electoral Bureau, overseen by the Chief Electoral Officer are put in charge of any investigations into violations of this code, they will report their findings directly to the Governor of San Andreas.
E.C. (1)02.
  1. Electoral Officers are to submit a declaration under oath as a commitment to tell the truth in the performance of their duties. If the official is later found to have lied whilst bound by the commitment, he/she is charged with Corruption of Public Duty as defined in the Penal Code under (4)16.
E.C. (1)02.
  1. The San Andreas Senate consists of 11 Senators, which are elected at once, once per 4 months. The people of San Andreas get one vote per spot.
E.C. (1)03.
  1. Elections will commence once every 4 months, unless they’re called for by the Chief Electoral Officer, on behalf of the Governor. Pre-quarter elections are only called if 4 or more Senators have been found unfit to discharge their duty, been removed from office or resigned from their position.
TITLE 2. PROCEDURE
E.C. (2)01. Pre-election phase
  1. Chief Electoral Officer announces the upcoming elections.
  2. The supporting documentation for that election is released by the Electoral Bureau.
  3. Candidates write their application, which they then forward to the Chief Electoral Officer.
  4. Applications are reviewed by the Electoral Bureau and processed.
  5. Candidate list is published by the Electoral Bureau.
E.C. (2)02. Campaigning phase
  1. Chief Electoral Officer announces the start of the campaigning phase.
  2. Candidates start their campaign by disclosing their manifesto.
  3. The highest polling candidates are invited to the closing debate.
E.C. (2)03. Voting phase
  1. Chief Electoral Officer announces the start of the voting phase, calling a halt to the campaigning.
  2. The people of San Andreas get a total of seventy-two (72) hours to cast their 11 votes.
  3. After the ballots close, the Electoral Bureau has forty-eight (48) hours to count and verify the votes casted, after which they disclose the results.
TITLE 3. FINANCES
E.C. (3)01.
  1. Every candidate which submits their application, is to raise $100.000 as a deposit payment to the Electoral Bureau.
E.C. (3)02.
  1. Candidates are only allowed to receive limited, one time amounts from the following parties:
    • Registered political party ($100.000).
    • Private citizen of San Andreas ($25.000).
    • Businesses, Unions or other special interest groups ($50.000).
E.C. (3)03.
  1. Candidates are to keep records of the received donations; these records are to be accessible by the Electoral Bureau at all times.
    1. Failing to keep, tampering with or fraudulently keeping the aforementioned records will be punished with charges of Fraud (2)16 as defined in the Penal Code.
TITLE 4. ETHICS
E.C. (4)01.
  1. Candidates and their staff are to maintain the highest standards possible, as they serve an exemplary function.
E.C. (4)02.
  1. Candidates are expected to have no felonies or recent misdemeanors on record. Case by case exceptions may be made at the Chief Electoral Officer’s discretion.
E.C. (4)03.
  1. Candidates are to show no disrespect to one another during the entire electoral process, this includes but is not limited to: advertisements, interviews, manifestos etc.
TITLE 5. OFFENSES
E.C. (5)01. Obstruction of the electoral process.
  1. A person or organization that intentionally puts the integrity and fairness of the electoral progress at risk with their actions.
  2. Electoral Code (5)01 is punishable by no less than 180 minutes imprisonment and no more than 300 minutes of imprisonment.
E.C. (5)02. False Advertising.
  1. A person or organization that intentionally spreads false information about a candidate to the public.
  2. Electoral Code (5)02 is punishable by no less than $50,000 in fines and no more than $250,000 in fines.
E.C. (5)03. Unethical behavior.
  1. A candidate who violates the ethical standards as defined in Title 4 of the San Andreas Electoral Code.
E.C. (5)03. Electoral fraud.
  1. A person or organization that intentionally commits fraud to affect the outcome of the elections.
E.C. (5)03. Political donation fraud.
  1. A candidate who knowingly alters, creates, or uses a written document with the intent to affect the electoral process.
TITLE 6. DISPUTES
E.C. (6)01.
  1. Election disputes are inherent to elections. Challenging an election, its conduct or its results, should however not be perceived as a reflection of weakness in the system, but as proof of the strength, vitality, and openness of the political system.
E.C. (6)02.
  1. The Electoral Bureau of San Andreas shall have jurisdiction over any civil action related to the execution of an election. Their findings are presented to the Chief Electoral Officer and the Governor upon completion.
E.C. (6)03.
  1. Decisions made by the Electoral Bureau are final and cannot be appealed, unless they’re taken to the Superior Court of San Andreas.
TITLE 7. ORGANIZATIONS
E.C. (7)01. Political parties
  1. Political parties recognized by the Electoral Bureau are listed in addendum I of the San Andreas Electoral Code. Only those listed are to be represented during the elections, every other candidate is considered to be independent.
    1. Registering a party:
      For a party to be recognized they must file for declaration of recognition, this is only granted to the parties that upkeep the highest standards of ethics and professionalism.
    2. Requirements:
      1. $250,000/year registration fee, which is to be raised during a public fundraiser.
      2. At least 5 active members.
      3. A party headquarters in a respectable area of urban or rural San Andreas.
      4. Internal elections to select party officials, once every 12 months.
E.C. (7)02. Public agencies
  1. Public agencies are prohibited from endorsing a candidate either internally or externally. This includes: appearing during campaigning events, wearing campaign material, making campaign donations and advocating for the candidate.
TITLE 7. CRITERIA
E.C. (8)01.
  1. Candidates are to meet the following criteria to be considered for a spot in the elections:
    1. A candidate must reside in the state of San Andreas for at least 20 years.
    2. A candidate must be at least 30 years of age.
    3. A candidate must be clear of prior felonies and misdemeanors.
    4. A candidate must be registered to a party, or be a registered independent.
    5. A candidate must upkeep the highest standards.
