An Act to regulate aviation law in San Andreas.
THE PEOPLE OF THE STATE OF SAN ANDREAS
DO ORDAIN AS FOLLOWS:

Section 1. Definitions.
  1. “Aircraft” refers to a vehicle that is used for or intended to be used for flight in the air.
  2. “Airplane” refers to an engine-driven fixed-wing aircraft heavier than air, that is supported in flight by the dynamic reaction of the air against its wings.
  3. “Rotorcraft” refers to a heavier-than-air aircraft that depends principally for its support in flight on the lift generated by one or more rotors.
  4. “Helicopter” refers to a rotorcraft that, for its horizontal motion, depends principally on its engine-driven rotors.
  5. “Altitude” refers to the the distance between the aircraft and the ground at vertical direction.
  6. “Greater Los Santos Metropolitan Area” refers to the City of Los Santos, and the towns of Blueberry, Dillimore, Montgomery and Palomino Creek.
  7. “Unincorporated cities and townships" refers to the City of San Fierro, the City of Las Venturas and Townships of Tierra Robada, et cetera, excluding the Greater Los Santos Metropolitan Area.
  8. “Law enforcement agency” refers to the Los Santos Police Department and San Andreas Sheriff's Department.
  9. “Correctional agency” refers to the San Andreas Department of Corrections.
  10. “Emergency services agency” refers to the agency whose primary function is not to enforce law, but to provide care to the citizens of San Andreas, such as the Los Santos Fire Department.
  11. “State agency” refers to all other state agencies, as defined by the State Constitution, not already defined as a law enforcement agency, correctional agency, or emergency services agency.
  12. “Mayday” refers to the transmission of imminent life-threatening emergency on board an aircraft.
  13. “Pan” refers to the transmission of emergency with no immediate danger to the aircraft or its passengers.
  14. “Aircraft registration” refers to registration of an aircraft with the government.
  15. “Flying license” refers to the government-issued certification of a person who is capable of flying an aircraft.
  16. “UNICOMM” refers to Universal Communications, public channel number 20.
  17. “Restricted airspace” refers to the areas that can not be flown over at any altitude, either on a permanent or a temporary basis.
  18. "Helicopter Space' refers to the length of a maverick helicopter from the front to back.
Section 2. Flying license and aircraft registration.
  1. Persons wishing to own and operate an aircraft in San Andreas must possess a valid flying license. Such license is to be obtained at Los Santos International Airport or another place designated by the government. The government may set a fair and reasonable free for such obtainment, and may mandate a fair and reasonable training regime as it deems necessary.
  2. Flying licenses need not be renewed. When a flying license is revoked by a law enforcement agency or another duly enabled state agency, either of which are acting in terms of law; such person who has been deprived of his or her flying license must renew it, if so authorized and if he or she intends to use the aircraft again.
  3. Members of the law enforcement, correctional, emergency services and state agencies are exempt from possessing a valid flying license while they are on duty within their respective agencies and operating aircraft owned by said agencies, notwithstanding the fact that they are required to go through appropriate training by their own agency.
  4. All aircraft, with the exception of law enforcement, correctional, emergency services and or other state agencies, are required to register their aircraft with the Bureau of Licensing, with a fee no greater than $15,000, and a renewal fee after a set amount of time decided by Bureau officials, no greater than $10,000.
  5. Exempt agencies may, at their discretion, register aircraft owned and operated by such agencies with the Bureau of Licensing, however no application fee nor renewal fee may be charged.
  6. The Bureau of Licensing will be the agency authorized by the State to manage aircraft registration. The Bureau is required to obtain the following information:
    1. Full contact information of the applicant, including an address and a phone number; and
    2. The make and model of the aircraft and the designated tail number, which must be 7 characters, and should only contain letters and numbers. Government agencies are exempt from this regulation.
Section 3. Basic flight protocol.
  1. Pilots, while they are operating an aircraft in San Andreas, must always be tuned into the Universal Communications (UNICOMM) channel, public channel number 20, for inbound and outbound voice transmissions.
  2. When taking off, the pilot of the aircraft, or the co-pilot designated by the pilot of the aircraft, must announce it over the UNICOMM channel, in the following format:
    • "Tail number", taking off from "location", VFR flight, "direction" departure.
  3. When landing, the pilot of the aircraft, or the co-pilot designated by the pilot of the aircraft, must announce it over the UNICOMM channel, in the following format:
    • "Tail number", landing at "location", full stop.
  4. During an emergency situation, the pilot of the aircraft, or the co-pilot designated by the pilot of the aircraft, may radio in to announce the emergency:
    • "Tail number", mayday mayday mayday, "situation" OR "Tail number", pan pan pan, "situation".
  5. The pilot may announce themselves, at their discretion, when they are entering or/and exiting airspace, such as Los Santos Airspace, maintaining or changing altitude, or when they are taxiing or squawking.
  6. Members of the law enforcement, correctional and emergency services agencies, while they are on duty, and operating the agency's vehicle for official purposes, may ignore the given radio protocol during emergency situations, like pursuits or/and search and rescues.
  7. All airplanes must maintain at least one thousand and five hundred feet (1500 FT) altitude from the ground level, while they are flying above the Greater Los Santos Metropolitan Area, and at least one thousand feet (1000 FT) altitude from the ground level, while they are flying above the unincorporated cities and townships, while raising altitude where needed.
  8. All helicopters must maintain one thousand feet (1000 FT) altitude from the ground level, while they are flying above the Greater Los Santos Metropolitan Area, and at least eight hundred feet (800 FT) altitude from the ground level, while they are flying above unincorporated cities and townships, while raising altitude where needed.
  9. Members of the law enforcement, correctional and emergency services agencies, while they are on duty, and operating the agency's vehicle for official purposes, may fly in lower altitudes during emergency situations,
  10. (( One thousand feet (1000 FT) is in-game as 1 Bar of altitude from sea level, with two thousand 2, and three thousand 3. However Pilots must understand and alter their altitude while flying over areas higher than sea-level accordingly))
Section 4. Restricted airspace.
  1. The San Andreas Correctional Facility and a half-mile radius surrounding the facility is considered restricted airspace at any altitude for private aircraft.
  2. Downtown Los Santos is restricted airspace between ground level and two thousand feet (2,000 FT) for all aircraft except helicopters from law enforcement, emergency services and state agencies, with the exception of takeoff and landing from helipads in Downtown.
  3. Any area within the unincorporated cities and townships which has skyscrapers or structures above 500 feet (500 FT) are restricted airspace between ground level and two thousand feet (2,000 FT) for all aircraft, with the exception of helicopters from law enforcement and emergency services agencies during emergency situations.
  4. The SAN Building, located in Downtown Los Santos, shall be exempt from this restriction on the navigation of aircraft below 2,000 feet. Aircraft taking off from the helipad on the SAN Building must ascend directly to 2,000 feet from takeoff before engaging in further maneuvering.
  5. Los Santos International Airport, San Andreas International Airport and Las Venturas International Airport, and a half a mile of area surrounding the such airports are restricted airspace between ground level and two thousand feet (2,000 FT), unless the aircraft are taking off or landing at such airports.
  6. Verdant Meadows Air National Guard base is considered restricted airspace between ground level and two thousand feet (2,000 FT).
  7. Temporary airspace restrictions may be imposed by law enforcement agencies, with the Los Santos Police Department having the authority over the City of Los Santos and the San Andreas Sheriff's Department over the State of San Andreas, excluding the City of Los Santos, for any period of time for safety and security, reasonable and proportionate to its purpose.
  8. Permanent airspace restrictions may be imposed by the State Legislature, by either amending this Act or adopting further Acts; through regulations adopted by the Bureau of Licensing in terms of another Act or Acts.
Section 5. Aircraft parking.
  1. Aircraft users may apply to the Bureau of Licensing for the registration of landing and parking facilities. The Bureau of Public Utilities will be responsible for, and must, inspect such facilities and be satisfied that the intended use of such facility will not unduly endanger public or individual safety; not cause unreasonable nuisance within the context of the area; and that it complies with any other health and safety regulations mandated by the government.
  2. Law enforcement officers may, at their discretion, allow aircraft users to move or reposition their aircraft in such a way as to comply with this Act and any corresponding regulations, if such law enforcement officer is satisfied that the error was made in good faith and not due to malicious intent or negligence.
  3. Los Santos International Airport, San Fierro International Airport, Las Venturas International Airport and can be used for airplane and helicopter takeoff and landing, as well as for parking of the such aircraft.
  4. No airplane can take off or/and land at any area other than the airports listed above, unless it is an emergency, the aircraft is able to land on water, or the landing site is approved by the Bureau of Licensing.
  5. The Los Santos Police Department Headquarters helipad can be used for helicopter takeoff and landing, as well as for parking of the such helicopters.
  6. The LSPD Hoover Heliport can be used for helicopter takeoff and landing, as well as for parking of the such helicopters.
  7. The San Andreas Sheriff's Department Headquarters helipad can be used for helicopter takeoff and landing, as well as for parking of the such helicopters.
  8. The All Saints General Hospital helipad and the Fort Carson Medical Center helipad can be used for helicopter takeoff and landing, as well parking of the such helicopters.
  9. The San Andreas Correctional Facility helipad can be used for helicopter takeoff and landing, as well as for parking of such helicopters.
  10. The Los Santos City Hall helipad can be used for helicopter takeoff and landing, as well as parking for such helicopters.
  11. No helicopter can take off or/and land at any area without at least four helicopter space between the closest object, and the helicopter's fuselage.
  12. No helicopter can take off or/and land at any area unless the operator of such aircraft previously gained permission from the owner of the area.
  13. Law enforcement, emergency services and correctional agencies may be exempt from the above if there is an emergency, however must observe appropriate safety considerations and policies.
Section 6. Air traffic control.
  • The Los Santos Police Department's Air Support Division, and the San Andreas Sheriff's Department's Air Support Unit members may serve as ad hoc air traffic controllers (ATCs) as necessary to ensure a safe airspace over San Andreas.
Section 7. Charges.
  1. Failure to adhere the flight protocols.
    Failure to adhere to the flight protocols in San Andreas, as defined in Section 3 of this Act.
    - Failure to adhere to the flight protocols is a felony punishable by no less than 45 minutes imprisonment and no more than 90 minutes imprisonment.
  2. Failure to adhere to ATC protocol.
    Failure to respond to ATC traffic, failure to identify to ATC or other aircraft when requested.
    - Failure to adhere to ATC protocol is a felony punishable by 180 minutes imprisonment (3 hours). Noncompliance may be met with force from the State Air National Guard.
  3. Failure to adhere the restricted airspace.
    Failure to adhere to the restricted airspace in San Andreas, as defined in Section 4 of this Act.
    - Failure to adhere to the restricted airspace is a felony punishable by no less than 60 minutes (1 hour) imprisonment and no more than 180 minutes imprisonment (3 hours). Noncompliance may be met with force from the State Air National Guard.
  4. Illegal parking of an aircraft.
    Failure to adhere to the aircraft parking, as defined in Section 5 of this Act.
    - Illegal parking of an aircraft is a infraction of no less then $10,000 and no more then $25,000.
  5. Relevant San Andreas Penal Code charges do also apply, such as, but not limited to; Reckless Operation of an Aircraft and Aerial Evasion, if the definition of the charges fit the actions taken by private pilots.

  • This bill, if passed, shall come into effect seven (7) days after being signed.
