C.C Resolution #010 - The Fair Gaming Act of 2011


PURPOSE: To create the Fair Gaming Act of 2011 and place new regulations and laws on any business providing gambling activities and regulate those activities in a more effective manner


SECTION 1: TITLE
This resolution may be cited as “The Fair Gaming Act””


SECTION 2: DEFINITIONS

Casino - a facility which houses and accommodates certain types of gambling activities

Gambling - the wagering of money or something of material value on an event with an uncertain outcome with the primary intent of winning additional money and/or material goods.

Gambling area – Any area within a casino where gambling games are present, whether they are electronic such as slot machines or manned areas such as blackjack tables, poker tables or roulette tables etc

Private gaming area - An area which is separate or partitioned off from the main gambling areas, for example a private poker room used for high stakes or VIP players.

Electronic manipulation – Changing or affecting the results of a game to ones advantage or disadvantage via electronic means

Permitted quotas – The set limitations on certain gambling activities permitted under section 7, 8 and 9


SECTION 3: LICENSING


  • The Los Santos Government hereby declares that it is illegal for any kind of registered or unregistered business including betting shops to permit, host or participate in any form of gambling within the grounds of their premises without a gambling license issued by Los Santos Government.

SECTION 4: CASINO OBLIGATIONS

  • all casinos are required to ensure that they have enough CCTV cameras, or that they are sufficiently placed to cover every gambling area or table. This also includes any private gaming areas.

  • Casinos are also required to have at least two or more security guards on duty during opening hours, if they are armed guards then they must be CCW licensed.

SECTION 5: ELECTRONIC MANIPULATION DEVICES & OTHER MODIFICATIONS

  • The Los Santos Government hereby declares that it is illegal for any business or individual involved in gambling or staff employed by those businesses to use any electronic device to alter the results of the game to give an unfair advantage or disadvantage to anyone involved in the game.

  • It is also illegal for modifications or alterations to be made to any gaming machine, table or other gaming apparatus which allows the game to be controlled, manipulated, altered or changed in any manner which gives an unfair advantage or disadvantage to anyone involved in the game.

SECTION 6: FAIR PLAY

  • Any games or event held by a business or organization in which gambling is involved that are organized, designed or arranged in such a way that it is impossible for players to win are strictly prohibited and illegal. All gambling games provided by any business or organization must be designed and or carried out in such a way that it gives all players a reasonable and equal chance of winning even if the chances are slim, for example a lottery or bingo draw.

SECTION 7: HOUSEHOLD GAMBLING

  • Any game held within the grounds of a private or rented residential home in which gambling is involved requires written permission from the Los Santos Gaming Commission if bets above $1,000 in value are to be involved. This only applies to card games such as blackjack, poker and to other games where a purpose built apparatus is required to play the game such as a roulette wheel and does not apply for example to personal wagers between friends on sporting events (non exhaustive).

SECTION 8: RAFFLES


  • Nightclubs, bars, restaurants and other businesses not normally associated with gambling may hold one promotional raffle, competition or other prize draw per week of which there is a cost to enter without the need for permission or a license provided the total cost of tickets or entry is no more than $1,000 otherwise a general gambling license will be required. Lottery draws do not fall under the umbrella of a raffle and thus no lottery or bingo draws may be held without the appropriate license.


SECTION 9: SLOT MACHINES IN BARS, RESTAURANTS HOTELS OR CLUBS

  • Bars, Restaurants, Clubs, Hotels and off-licenses are permitted to hold no more than two slot machines within the grounds of their premises without the need for a general gambling license.


SECTION 10: LEGAL GAMBLING AGE & LEGAL AGE TO ENTER A CASINO

  • The Los Santos Government hereby declares that it is illegal for any person under the age of 18 to participate in any raffle, lottery, competition or prize draw of which there is a cost of more than $1,000 to enter where there is the promise of a prize of monetary value. Nor may any persons under the age of 18 participate in parimutuel betting via any betting shops or other betting agents.

  • With the exception of lottery draws persons aged 16 or over may with parental consent enter any raffle, competition or prize draw of which there is a cost of less than $1,000 to enter. No age limits apply if there is no cost to enter

  • No person under the age of 18 may enter casino without being accompanied by a guardian or parent, persons under the age of 16 may not enter at all.

  • No persons under the age of 21 may play games housed within the grounds of a casino and as such casinos are required to ask any person who looks under the age of 21 for ID.

SECTION 11: ADVERTISING AND GAMBLING
  • No casinos or businesses holding gambling events may publish false or misleading advertisements relating to their games, events or their business in general. Including but not limited to; advertising high stakes games when none of the advertised type are offered.

  • With regards to high stakes poker, blackjack and other high stakes games , the Los Santos Gaming Commission considers High Stakes to be any minimum bet or buy-ins above $50,000.


SECTION 12: CONSEQUENCES AND PUNISHMENTS FOR FAILURE TO COMPLY WITH THIS ACT


  • The owners of any casino or other gambling establishment, it's staff or indeed any other persons which are found in breech of section 5 and or section 6 of this act are to be charged with fraud in accordance with 326. of the San Andreas Penal Code.

  • Anyone who is found to be allowing, encouraging or permitting any persons under the age of 21 to participate in any games housed in a casino or allowing, encouraging or permitting any persons under the age of 18 to participate in any raffle, lottery, competition or prize draw of which there is a cost of more than $1,000 to enter shall receive a 10 minute arrest $5,000 fine and charged with “Soliciting gambling to a minor” and an asset forfeiture.

  • Any persons who fail to obtain the correct gambling license for their business or organization or exceed any permitted quotas under this act shall be charged and punished in accordance with 221 of the San Andreas Penal Code.

  • Businesses or organizations which fail to adhere to this act may also receive fines of up to $20,000 per violation from the Los Santos Government, Los Santos Gaming Commission or any Law Enforcement Official and may also be subject to getting their licenses revoked as well as other sanctions which may be imposed by the Los Santos Government.
