ACT NO. 020-16
An Act to establish and regulate an open carry system in the state of San Andreas.



THE PEOPLE OF THE STATE OF SAN ANDREAS
DO ORDAIN AS FOLLOWS:

Section 1. DEFINITIONS
  1. ”Open Carry” refers to the act of openly carrying a firearm on one’s person without the use of any concealment.
  2. "State of Emergency" as defined in the San Andreas State Constitution. (Section II, 5)
  3. "Firearm" refers to a small arms weapon, as a rifle or pistol, from which a projectile is fired by gunpowder.
  4. "Handgun" refers to a firearm that can be held and fired with one hand; handheld; pistol. In this case it specifically refers to a firearm that is semi-automatic.
  5. "Long gun" refers to what is typically known as a "shotgun" and semi-automatic rifles.
  6. "License to purchase a firearm" refers to a license that is required by the state of San Andreas in order to purchase a firearm.
  7. "Hunting zones" refers to an area designated by the San Andreas State Senate as a location in which hunting and open carry of hunting rifles, as well as handguns, is permitted.
  8. "Open carry zone" refers to an area designated by the San Andreas State Senate as a location in which open carry of a handgun is permitted.

Section 2. OPEN CARRY
  1. The San Andreas State Senate is responsible to allocate locations of certain public areas where people, who have fulfilled the requirements outlined in section 2B of this act, where open carry will be permitted. This area is known as the open carry zone.
  2. An individual who wishes to open carry their firearm must first obtain a license to purchase a firearm. Any person who owns a license to purchase a firearm is permitted to open carry in designated the open carry zone.
  3. An individual who has fulfilled the necessary requirements for open carry, which are outlined in section 2B of this act, may only openly carry handguns in designated open carry zones. This only applies to the open carry zone and not to private property.

Section 3. OPEN CARRY ZONE
  1. The entire State of San Andreas, with the exception of:
    • The City of Los Santos.
    • San Fierro Airport
    • Las Venturas Airport
    • The National Guard Airstrip
    • Sidewalks adjacent to any Sheriff's Department property.
    • The entire block surrounding the San Andreas Sheriff's Department headquarters in Dillimore.

Section 4. HUNTING & OPEN CARRY
  1. The San Andreas State Senate is responsible to allocate locations of certain areas where people, who have fulfilled the necessary requirements outlined in section 4B of this act, are permitted to hunt. These areas shall be known as hunting zones.
  2. An individual who has obtained a license to purchase a firearm is permitted to hunt in designated hunting zones.
  3. An individual who has fulfilled the necessary requirements, outlined by section 4B of this act, to hunt may open carry long guns and handguns in hunting zones. They are only permitted to open carry long guns if they are participating in an active hunt.
  4. This act nullifies the Hunting and Fishing Ordinance docked under NO. #019-JS

Section 5. RESTRICTIONS & EXCEPTIONS
  1. Open carry is not permitted during a state of emergency unless the Governor of San Andreas explicitly states otherwise.
  2. An individual may only use the firearm(s) of which they have the required permits to use, when open carrying. If the person lacks the required permit to carry the specific type of handgun of which they are openly carrying in either the open carry zone or in a hunting zone, they shall be dealt with in accordance with the law.
  3. An individual may openly carry any firearm inside their private property and/or other people's private property, given that the property owner has given their consent. This is permitted throughout the entire State and not limited to the open carry zone.
    • Business owners of businesses located outside the open carry zone must inform their local Law Enforcement agency that open carry is being conducted inside the property in question, if open carry takes place during the time that the business is open to the public. Such a notification must be dispatched to the local Law Enforcement at least 5 minutes prior to opening. This requirement does not apply to businesses located inside the open carry zone, they are allowed to allow open carry inside their businesses without prior notification to local Law Enforcement.
  4. An individual may not open carry a firearm within a 2000 ft radius of the San Andreas Correctional Facility or inside any government owned building.
  5. The contents outlined in this act does not apply to law enforcement officers on active duty.
  6. An individual must state that they are open carrying during a traffic stop with any law enforcement officer.
  7. An individual who is transporting a weapon in a vehicle must ensure that their firearm(s) are properly secured within a locked gun case, lockbox, or strapped in a holster with the safety on.

Section 6. REVOCATION
  1. A license to purchase a firearm can be suspended or revoked for violation of any of the regulations in this act for a specific individual in accordance with the San Andreas Penal Code (9)13.

    A person who carries concealed a legal, registered firearm that is not authorized as a conceal-carry weapon.
    A person who carries concealed a legal, registered firearm that they are not authorized to carry concealed.
    A person who does not carry proper permits or documentation for their weapon or occupational weapon usage.
    Any other firearms regulatory violations as set by the appropriate licensing agency.
  2. A license to purchase a firearm can be permanently revoked by order from the San Andreas Supreme Court and or the San Andreas Superior Court for a specific individual, if said individual has violated the terms of open carry outlined in this act or if an individual is proven, or could potentially be for mental health reasons in spite of whether this person has been convicted of a criminal offense or not, to be a danger to society. This shall be done at the discretion of the court.
  3. Open carry authorization can be temporarily nullified by the courts during an injunction order within a specific area at the discretion of the San Andreas Supreme Court and/or the San Andreas Superior Court.
