THE PROTEST AND ASSEMBLY ACT

An Act to To protect and expand on the peoples right to Peaceful Assembly in accordance with the First Amendment of the United States Constitution.
THE PEOPLE OF THE STATE OF SAN ANDREAS
DO ORDAIN AS FOLLOWS:

Section 1. Definitions.
  1. "Protest" refers to a group of people gathered to participate in a public demonstration in opposition to something.
  2. "Rally" refers to people who come together for a common purpose.
  3. "Assembly" refers to a group of people gathered together for a common reason, as for a legislative, religious, educational, or social purpose.
  4. "Counter protest" refers to a group of people gathered to participate in a public demonstration in opposition to a specific protest, rally or assembly.
  5. "Security risk" refers to any event that could result in the damage, destruction or harm to a person, property or cause alarm harassment and distress. Alternatively a security risk is anything that comprises the safety, peace or life of the public.

Section 2. Repeal and Amendment of existing Legislation
  1. The Hoover Acts Article I is replaced will be replaced by his act. All other parts of the Hoover Acts will not be effected by this act in particular.
Section 3. Responsibilities and Obligations
  1. The Los Santos Police Department are responsible to ensure that the people of held protests, rallies and assemblies are protected at all times in their jurisdiction. They must be available for direct deployment to secure a protest, rally or assembly.
  2. The San Andreas Sheriff's Department are responsible to ensure that the people of held protests, rallies and assemblies are protected at all times in their jurisdiction. They must be available for direct deployment to secure a protest, rally or assembly.
  3. The Los Santos City Government are responsible of processing permits. They may take no longer than 24 hours to process an application.
  4. The San Andreas Department Of Corrections are allowed to ensure that held protests, rallies and assemblies do not compromise the safety of the state's correctional facility, its inmates or its personnel. They are not required to be present at said protest, rally or assembly or protect the people of said event.
  5. The people holding the protest, rally or assembly must ensure that they are never obstructing emergency vehicles, hospitals, police stations, courts, fire stations or correctional facilities. Protests, rallies or assemblies may take place outside such establishments and/or around them, but they can not hinder them from operating under any circumstances. If this happens it should be considered an illegal activity.
Section 4. Permits
  1. If a group of people wish to hold a protest, rally or assembly they can do so wherever they wish. However, if the group consists of 20 or more people they require a permit.
  2. If a group of people wish to hold a protest, rally or assembly which includes marching down a road, or holding it on a road, they require a permit and must specify this in their permit application.
  3. The Los Santos City Government may not ask for anything other than: I) The location of the protest, rally or assembly and II) contact details of the applicant.
  4. The only time a permit can be denied is if the protest, rally or assembly in question poses a security risk.
Section 5. Free Speech Zones
  1. The San Andreas Legislature is responsible to allocate locations certain public areas for the purpose of holding a protest, rally or assembly.
  2. No person can be denied the right to hold a protest, rally or assembly in a Free Speech Zone under any circumstances.
  3. A permit is never, under any circumstances, required to hold a protest, rally or assembly in a Free Speech Zone.
  4. The following circumstances must arise if a protest, rally or assembly in a Free Speech Zone is to be closed down:
    • The protest is creating a security risk. However, the LSPD and SASD must do their utmost to protect the freedom of speech and try to fight off any threats that could potentially be seen as security risk.
    • A majority of protesters are actively engaging in illegal activity at the time of the protest, rally or assembly.
Section 6. Private property
  1. If a protest, rally or assembly takes place on private property no permit is required regardless of how many participants there are. The people in question must, however, have consent from the owner of the property.
  2. Protesters on private property may hire their own security if they wish to do so, given that the security personnel have the required permits to act as security.
  3. A protest, rally or assembly on private property can only be closed down if:
    • A majority of protesters are actively engaging in illegal activity at the time of the protest, rally or assembly.
    • The owner of the property requests it the people involved to disperse.
Section 7. Counter protests
  1. Counter protests require no permit. The permit used for a protest, assembly or rally applies to them as well given that one is required. A counter protest shall be considered as a separate protest in every other regard than the previously mentioned.
  2. A counter protest can be closed down during the following circumstances:
    • The protest is creating a security risk. However, the LSPD and SASD must do their utmost to protect the freedom of speech and try to fight off any threats that could potentially be seen as security risk.
    • A majority of protesters are actively engaging in illegal activity at the time of the protest, rally or assembly.

  • This bill, if passed, shall come into effect seven (7) days after being signed.
