ACT NO. 010-16

An Act to establish a Port Authority responsible for the stewardship of port lands in and around Los Santos, San Andreas and supporting maritime trade and commerce.


THE PEOPLE OF THE STATE OF SAN ANDREAS
DO ORDAIN AS FOLLOWS:

  • Section 1. Definitions.
    1. "Port of Los Santos" refers to the collective operations of businesses, freelance workers and self-employed workers in and around the area of Ocean Docks.
    2. "Los Santos Loading Bay" refers to the geographical area where cargo is transported to and from vessels in Ocean Docks. The Los Santos Loading Bay falls within the boundaries marked in red on this map.
    3. "Los Santos Harbor" refers to the island portion of Ocean Docks that is connected by three separate bridges to mainland Los Santos. The Los Santos Harbour falls within the boundaries marked in blue on this map.
    4. "Ocean Docks" refers to the District of Ocean Docks in the City of Los Santos, San Andreas, USA. Ocean Docks falls within the boundaries marked in yellow on this map.
    5. "Independent corporate agency of the City of Los Santos" refers to any institution that is overseen by the Mayor of Los Santos, but is given autonomy over how it carries out its core functions or responsibilities.
    6. "Mayor" refers to the elected position of the Mayor of Los Santos.
    7. "Executive Director" refers to the Executive Director of the Los Santos Port Authority.

  • Section 2. Los Santos Port Authority
    1. This Act hereby establishes the 'Los Santos Port Authority' as an independent government agency of the Los Santos City Government.
    2. This Act replaces Executive Order #001 as the governing document of the Los Santos Port Authority.
    3. The Los Santos Port Authority shall exist to ensure the Port of Los Santos operates in an efficient manner, to screen imported and exported cargo transiting through the Los Santos Loading Bay and to provide a civilian security service for the Port of Los Santos.
    4. The Los Santos Port Authority shall maintain primary property rights over the Los Santos Harbor and may lease individual buildings, facilities or equipment to third-party individuals or organizations at its discretion.
    5. The Los Santos Port Authority may enter into contractual commercial agreements with third-party individuals or organizations to provide goods or services necessary to its operation.
    6. The Los Santos Port Authority, despite acting under the City of Los Santos, does not retain government worker protection for any employee bar the Executive Director.
    Section 3. Executive Director of the Los Santos Port Authority
    1. The Mayor of Los Santos shall hold responsibility for appointing an 'Executive Director of the Los Santos Port Authority' to oversee the Los Santos Port Authority. The Executive Director may also be dismissed at the Mayor’s discretion.
    2. The Executive Director of the Los Santos Port Authority will be responsible for, in addition to the responsibilities listed in Section 3, overseeing the day-to-day operations of the Los Santos Port Authority, establishing recruitment procedures, establishing an internal rank and organizational structure, providing health and safety training, issuing disciplinary action, paying employee salaries, delegating responsibility where appropriate, appointing corporate officers to oversee its operations and other such duties necessary to operation of the Los Santos Port Authority.
    3. In the absence of the Executive Director of the Los Santos Port Authority, the Mayor of Los Santos will automatically assume their duties, powers and responsibilities.
    Section 4. Cargo Screening
    1. All cargo imported into the Los Santos Loading Bay may be subject to screening for security purposes.
    2. The exact process by which cargo is subject to screening is to be determined by the Executive Director of the Los Santos Port Authority.

    Section 5. Security
    1. The Los Santos Port Authority shall function, in part, as a private security service for Port of Los Santos, its equipment and facilities, as well as the personnel working within it.
    2. The Los Santos Port Authority shall maintain an internal department with the specific responsibility for carrying out security-related functions.
    3. Employees who are not part of the Los Santos Port Authority's internal security department shall not, under any circumstance, be permitted to carry out security-related functions.
    4. Employees performing security-related functions are required to wear a visible identification badge at all times.
    5. Employees performing security-related functions should verbally identify themselves as security when asked or when it is relevant to their duties.
    6. Employees performing security-related functions are furnished with a departmental radio (under the callsign "PORT")
    7. Employees performing security-related functions whilst equipped with firearms must hold a valid License to Purchase a Firearm (PF) and a San Andreas Guard Card (GC).
    8. All security-related vehicles shall be readily identifiable as property of the Los Santos Port Authority.
    9. The Los Santos Port Authority shall be permitted to perform the following security functions:
      1. Patrolling on foot or in a vehicle within the confines of Ocean Docks.
      2. Requesting identification from any individual intending to import or export cargo from Ocean Docks.
        1. If an individual refuses to provide identification the Los Santos Port Authority shall be permitted to deny the individual access to the Los Santos Loading Bay.
        2. The Los Santos Port Authority shall not be permitted to utilize identification as a crime-detection measure.
      3. Detaining individuals who, either by violating the San Andreas Penal Code or any relevant statutes, impede the functions of the Port of Los Santos or pose a significant risk to the safety of any individual within the confines of Ocean Docks.
        1. Once detained, the Los Santos Port Authority shall be required to inform the Los Santos Police Department of the incident. The Los Santos Police Department will assume responsibility for issuing a resolution to the incident.
        2. If the Los Santos Police Department is unable to respond, the San Andreas Sheriff's Department shall take over responsibility for issuing a resolution.
        3. If neither the Los Santos Police Department nor the San Andreas Sheriff's Department is able to respond, the Los Santos Port Authority shall release the individual(s) in question, and instead, submit a formal report to either agency regarding the incident.
        4. Individual(s) may be detained for a maximum of thirty minutes by the Los Santos Port Authority, after which they must be immediately released.
        5. San Andreas State Agency employees acting in an official capacity may not be detained or denied entry to any part of Ocean Docks by any employee of the Los Santos Port Authority.
        6. Any individual who, if detained by the Los Santos Port Authority, requests medical attention, shall have an emergency call made on their behalf to the Los Santos Fire Department.
        7. The Los Santos Port Authority shall not attempt to detain or pursue any individual who withdraws a firearm, however, they may exercise their right to self-defense if necessary.
        8. The Los Santos Port Authority shall not attempt to pursue or detain any individual who is operating a mobile motor vehicle, however, they may exercise their right to self-defense if necessary.
        9. In the event of Section 5. H.3.G or Section 5. H.3.H occurring, the Los Santos Port Authority should make an emergency call to the Los Santos Police Department and/or the San Andreas Sheriff's Department, informing them of the incident.
    Section 6. Corporate Financial Disclosure(s)
    1. The Los Santos Port Authority shall, either through its Executive Director or a designated corporate officer, provide the Los Santos City Government with a comprehensive financial statement detailing its operating revenue and expenses, capital expenditures, personnel salaries or related commercial or corporate activities no less than once (1) per month.
    2. The exact requirements of these financial statements are to be determined by the Los Santos City Government and may change by executive order of the Mayor of Los Santos, or the Mayor's designated official.
    Section 7. Violations
    1. The Executive Director of the Los Santos Port Authority shall establish a procedure for reporting misconduct within the Los Santos Port Authority that is open to the public.
    2. The Executive Director of the Los Santos Port Authority shall assume responsibility for investigating any alleged non-criminal violations of the provisions of this Act.
    3. The San Andreas Department of Justice shall assume responsibility for investigating any alleged criminal violations of the provisions of this Act.
    4. Complaints from the leadership of any San Andreas State Agency that are non-criminal in nature regarding the Los Santos Port Authority should, prior to any other action being taken, attempt to be resolved through negotiation with the Executive Director of the Los Santos Port Authority and the Mayor of Los Santos.

    • This bill, if passed, shall come into effect seven (7) days after being signed.
