Section 1. Definitions.
- ADULT - Any mentally sound citizen above the age of 18, regardless of race, gender, religion or appearance
- MARRIAGE - The legal joining of two unrelated ADULTS, regardless of gender or sexual orientation
- SPOUSE - Refers to either participant of a MARRIAGE
- DIVORCE - The legal termination of a MARRIAGE
- OFFICIANT - An official legally empowered to officiate a marital ceremony. This is typically a judge or religious official
- PETITION FOR DISSOLUTION OF MARRIAGE - Civil court case involving the involuntary termination of a marital union
- SPOUSAL PRIVILEGE - Privacy privilege for statements made between spouses
Section 2. Definition of Marriage.
- Any ADULT citizen in San Andreas may marry another ADULT citizen, regardless of gender or sexual orientation, as long as neither participant are currently in a marital union.
- Two adults planning to become married must obtain a marriage license, officiated through the Los Santos Government's Bureau of Licensing at least three (3) days before marrying.
- The marriage must be officiated by a judge or religious figure
- It is the duty of the officiant to fill out the marriage license and return it to the Bureau of Licensing within seventy two (72) hours after the marriage is officiated.
Section 3. Termination of Marital Unions
- Marital unions must only be terminated by divorce, the legal dissolution of a marriage
- Divorce may be voluntary, which will require a couple to file with the Bureau of Licensing for their marriage to be officially dissolved.
- Divorce may be unvoluntary as well, handled through a Petition for Dissolution of Marriage filed with the San Andreas Civil Court.
- The terms of a divorce are to be decided by the handling judge.
Section 4. Spousal Rights
- Spouses may exercise control over their spouses' health or legal decisions when said spouse is mentally or physically incapacitated.
- In the absence of a signed will, a spouse is entitled to the property owned by their spouse in the event that one participant in the union dies.
- Spouses are subject to spousal privilege, which provides legal protection for anything said from one spouse to another. If any spouse breaks the secrecy of this privilege, what he or she says may not be used as evidence in a court of law.
- This bill, if passed, shall come into effect seven (7) days after being signed.
