ORDINANCE NO. 024-JS
An Ordinance to provide opportunities to small businesses and businesses owned by disadvantaged groups.
    THE PEOPLE OF THE CITY OF LOS SANTOS
    DO ORDAIN AS FOLLOWS:

    Section 1. Definitions.
    • “Bureau” refers to the Department of Public Works' Bureau of Contract Administration.

      “Minority Owned Business Enterprise” or “MBE” refers to a business which is at least 51% (fifty one percent) owned and controlled by United States citizens or legal permanent residents who are members of the following groups: Black American, Hispanic American, Native American, Asian-Pacific American or Subcontinent Asian American.

      “Small Local Business Enterprise” or “SLB” refers to a business which occupies primary work space within Los Santos, at least 75% (seventy five percent) of all work is done within Los Santos, and gross receipts must total less than $3 million for the previous fiscal year.

      “Women Owned Business Enterprise” or “WBE” refers to a business which is at least 51% (fifty one percent) owned and controlled by United States citizens or legal permanent residents who are women.
    Sec 2. Certification and preference.
    • (A) The Bureau shall be responsible for the certification of businesses as an MBE, an SLB or a WBE and matters related thereto.
    • (B) Businesses which are certified as an MBE, an SLB or a WBE, shall be given a preference discount by the City when said businesses are bidding for contracts in competition with other businesses which are not certified.
    Sec 3. Calculation of preference.
    • A 10% preference discount is given to the bids of certified businesses for each certification held. The preference is determined by taking 10% of the lowest bid that is proposed by a non-certified business, and subtracting that amount from the bid of the certified business.
      I hereby certify that the foregoing ordinance was passed by the Council of the City of Los Santos, at its meeting of 28 June 2014.
