ORDINANCE NO. 020-JS
An Ordinance providing for a comprehensive framework wherein education will take place in Los Santos.
THE PEOPLE OF THE CITY OF LOS SANTOS
DO ORDAIN AS FOLLOWS:


Section 1. Definitions.
  • “(this) Ordinance” refers to this Education Ordinance.

    “Board of Education” or “Board” refers to the Los Santos Board of Education as defined in Section 2(D).

    “CCTV camera” refers to a closed circuit television camera.

    “Chief administrative officer” refers to the official mandated to manage and oversee a department or institution.

    "City Council" refers to the Los Santos City Council.

    “Educational institution” refers to elementary-, middle- and high schools, as well as tertiary institutions.

    “Educational Institution Operations Permit” or “EIOP” refers to the permit required to operate an educational institution within Los Santos.

    “Fire Department” refers to the Los Santos Fire Department.

    "Fire Marshal's Office" refers to the named subsidiary of the Los Santos Fire Department.

    “Los Santos” refers to the geographical City of Los Santos.

    “Local government” refers to the political institution governing the City of Los Santos (commonly the “Government of the City of Los Santos”).

    “Private school” refers to any educational facility operating under guidance and funding not given by the Los Santos Government, but rather a secondary source such as donations and or fundraising.

    “Public school” refers to any educational facility operating under direct guidance and funding from the Los Santos Government.

    “Mayor” refers to the Mayor of the City of Los Santos.

    “Office of Licensing” or “Office” refers to the Los Santos Office of Licensing, under the Los Santos Department of City Planning.

    “School District” refers to the Los Santos School District as defined in Section 2(A).

    “Superintendent” refers to the Superintendent of the Los Santos School District as defined in Section 2(B).

    “Penal Code” refers to the Penal Code of the State of San Andreas.

    “Personal Teacher’s License” or “PTL” refers to the license required to operate and seek employment as a teacher within Los Santos.

    “Principal Education’s License” or “PEL” refers to the license required to operate and seek employment as a Principal within Los Santos.

    “Various schools” refers to both private and public schools as elsewhere defined.
Sec. 2. Los Santos School District.
  • (A) The Los Santos School District (LSSD) is the governing institution which oversees, manages and supports the public schools within the City of Los Santos.
  • (B) The Superintendent is the chief administrative officer of the School District and is appointed by the Mayor, subject to City Council confirmation.
  • (C) The Superintendent is responsible for -
    • (i) Maintaining the ethical standards of all schools within the School District; and
    • (ii) Acting as the Chairperson of the Board of Education, therefore ensuring the Board meets at the appropriate times and discusses the relevant issues; and
    • (iii) Enforcing the various provisions of this Ordinance where applicable.
  • (D) The Superintendent, the Mayor, the Education Officer, an official representing a relevant branch of the Fire Department and one appropriate individual designated by the Superintendent shall constitute the five member Los Santos Board of Education.
    • (i) The individual designated by the Superintendent and the official representing the Fire Department are to be designated at the beginning of each ordinary term, and may only be removed by the appointing authority on basis of inactivity or incompetence.
  • (E) Unless otherwise indicated, private schools do not form part of the School District, and act independently of local government guidance or assistance.
Sec. 3. Education Officer.
  • (A) The Education Officer is the chief liaison and between the various schools within Los Santos and the local government.
  • (B) The Education Officer is responsible for ensuring and facilitating clear and constant dialogue and cooperation between the various schools and the local government.
  • (C) The Education Officer is appointed by the Mayor at his or her discretion, however must –
    • (i) Have prior experience as a teacher at a public or private school; and
    • (ii) Not have been convicted of an offense as defined by Section 4(C)(ii).
Sec. 4. Licensing.
  • (A) School faculty participating or wishing to participate in teaching at the various schools are required to lawfully obtain and hold a license as determined by this Ordinance.
  • (B) Licenses established by this Ordinance are granted, suspended, revoked and generally managed by the Office of Licensing.
  • (C) The validity requirements and prerequisites for the obtainment and existence of the various licenses established by this Ordinance are subject to the discretion of the chief administrative officer of the Office of Licensing or another official who has been delegated the relevant authority, in consultation with the Board of Education.
    • (i) Background checks for prior criminal history or inappropriate behavior at a past place of similar employment are required in the exercise of such discretion.
    • (ii) Persons convicted of –
      • - Child abuse, or a similar offense; or
        - Child endangerment, or a similar offense; or
        - Murder, or related offenses; or
        - Torture, or a similar offense; or
        - Rape, or a similar offense; or
        - Statutory rape, or a similar offense; or
        - Sexual assault, or a similar offense; or
        - Terrorism, or a similar offense;
      in terms of the Penal Code or ordinance, may not be considered for holding such license.
  • (D) Guest teachers are exempt from the provisions of Section 4(A) and supporting provisions, however must –
    • (i) Not be employed permanently by such school; and
    • (ii) Teach or lecture in a subject or field that is relevant to the goals, purposes or curricula of such school, as determined by the Superintendent.
  • (E) The licenses as established by this Ordinance are –
    • (i) The Professional Teacher's License (PTL), which is required to participate or engage in teaching activities at one of the various schools; and
    • (ii) The Principal Educator's License (PEL), which is required to act as a principal of one of the various schools.
  • (F) Any educational institution within Los Santos is required to lawfully obtain and hold an Educational Institution Operations Permit (EIOP).
Sec. 5. Offenses.
  • (A) Schools employing teachers who do not hold the required licenses or who guilty of an offense in terms of Section 4(C)(ii) are subject to a fine as determined by the Office of Licensing.
  • (B) Teachers who unlawfully obtain and subsequently hold a license in terms of this Ordinance are subject to a fine no less than $10,000 as determined by the Office of Licensing; as well as imprisonment as determined by the relevant authorities.
  • (C) Educational institutions operating without lawfully possessing a valid Educational Institution Operations Permit are subject to a fine no less than $50,000 as determined by the Office of Licensing.
Sec. 6. Funding.
  • (A) Funding for the School District is to be determined by the City Council in plenary session at least once during an ordinary term, in consultation with the Board of Education. Such funding must be appropriate and relative to the needs and requirements of the School District.
  • (B) The Superintendent shall thereafter at his or her discretion divide the funding and budget received from the local government between the public schools, relative to the needs and requirements of such schools.
  • (C) School District facilities are exempt from any form of property tax as established by the local government.
  • (D) Any state or federal property taxes for School District facilities are to be carried by the local government.
  • (E) Private schools are entitled to reduced same property tax if so decided by the City Council in consultation with the Board of Education.
Sec. 7. Safety.
  • (A) The Superintendent, in consultation with the Fire Marshal's Office as well as the Principal of the relevant public school, must establish safety and security guidelines and policy for each public school within Los Santos.
  • (B) In addition to Section 7(A), each public school must –
    • (i) Have a CCTV camera viewing the interior and exterior immediately adjacent to the school’s main or alternative entrances; and
    • (ii) Have a working and maintained fire suppression system, with at least two fire alarm switches located at locations deemed appropriate; and
    • (iii) Have at least two fire extinguishers located at locations deemed appropriate.
  • (C) In the case of private schools, the relevant managing entity of that school must determine appropriate measures in ensuring the safety and security of attendees and visitors of that school.
  • (D) The Fire Marshal's Office may at its discretion flag a school, public or private, as an unsafe educational environment, whereafter such school shall cease all operations until the Fire Marshal's Office deems the environment adequate.
  • (E) Staff or faculty, including teachers, may not subject any attendees of the relevant public school to corporal or physical punishment. Private schools may subject attendees to such punishment with the express consent of the parent or guardian of the attendee. No clause of this provision exempts staff, faculty, teachers or school management from criminal prosecution in terms of state or federal law.
Sec. 8. Curriculum.
  • (A) The curriculum of the School District shall be determined by the Board of Education in plenary session with the appropriate involvement of the relevant parent and teacher association, at the beginning of each school year.
  • (B) At minimum, the curriculum of the School District must include the following –
    • (i) Mathematics;
    • (ii) Science;
    • (iii) History; and
    • (iv) English.
  • (C) The curriculum of private schools is subject to the internal policy and guidelines of the relevant private school managing body, however must at minimum include –
    • (i) Mathematics, in an appropriate form; and
    • (ii) English.
Sec. 9. Miscellaneous provisions.
  • (A) The Los Santos Educational Reform Act of 2013 is hereby repealed and substituted with this Ordinance.
  • (B) The Los Santos Educational Reform Act of 2013, in whole or in part, shall remain in force until such a time that the provisions of this Act are fully implemented.
  • This bill, if passed, shall come into effect seven (7) days after being signed.
