The Anti Hate Crime Act of 2011

* The Anti Hate Crime Act passed through the City Council with a vote of seven to zero.

Mayor Hoover, Councilman Verve, Councilman Fontana, Councilwoman Patrice, Councilman Tomson, Commissioner Collins and Commissioner Abbruzi voted in favor.

Deputy Mayor Woods, Chief Sokolov and Sheriff Roberts did not vote.

C.C Resolution #03

To ensure criminal activity that occurs when a perpetrator targets a victim in a clear and present manner because of his or her perceived membership in a certain social group, usually defined by racial group, religion, sexual orientation, disability, class, ethnicity, nationality, age, gender, gender identity, social status or political affiliation bears an extra charge to discourage such bias crimes from occurring and imbue legal liability on the perpetrator of the crime



SEC. 1. SHORT TITLE.
This Resolution may be cited as the "The Anti Hate Crime Act."


SEC. 2. DEFINITIONS.

  • Hate Crime - Assault, injury, murder, deprivation of property or continued harassment on the clear and present basis of certain perceived membership to a certain social group, usually defined by racial group, religion, sexual orientation, disability, class, ethnicity, nationality, age, gender, gender identity, social status or political affiliation.
  • Legal Liability - The weight of the financial, property or monetary damages.
  • Violent Crime - A crime in which the offender uses or threatens to use violent force upon the victim.
  • Non-Violent Crime - Any crime in which the offender uses non-violent methods to cause financial damage, property damage, or any form of non-violent harassment upon the victim.


SEC. 3. PROHIBITING BIAS-MOTIVATED VIOLENT CRIMES.

  • We, the City Council of Los Santos, hereby declare that any violent crime perpetrated on a victim due to the victim's perceived membership of any social group, usually defined by racial group, religion, sexual orientation, disability, class, ethnicity, nationality, age, gender, gender identity, social status or political affiliation will bear an extra charge which is added onto the present charges regarding the crime.


SEC. 4. PROHIBITING BIAS-MOTIVATED NON-VIOLENT CRIMES.

  • We, the City Council of Los Santos, hereby declare that non-violent crimes perpetrated on a victim due to the victim's perceived membership of any social group, usually defined by racial group, religion, sexual orientation, disability, class, ethnicity, nationality, age, gender, gender identity, social status or political affiliation will bear an extra charge which is added onto the present charges regarding the crime.


SEC. 5. CONSEQUENCES AND ACTIONS TAKEN BY FAILING TO COMPLY WITH THIS ACT.

  • In the scenario that someone is found guilty by the Supreme Court of San Andreas and has indeed committed a Violent Hate Crime with clear and present malicious intent, we declare the perpetrator shall receive an additional charge to be named as a "Violent Hate Crime" which bears individually a $15,000 dollar addition to bail and incarceration for a period of two months or more as determined by the Supreme Court of Los Santos as well as bear the legal liability for the damages incurred by the victim. In the scenario that someone is found guilty by the Supreme Court of San Andreas of committing a Non-Violent Hate Crime with clear and present malicious intent, we declare the perpetrator shall receive an additional charge to be named as a "Non-Violent Hate Crime" which bears individually a $10,000 dollar addition to bail and incarceration for a period of one month or more as determined by the Supreme Court of Los Santos.
