C.C Resolution #01

To prevent journalists, reporters, and all news networks and their employees from slandering or making defamatory statements towards any government agency, private business or organization, and any legal citizen of the United States of America. To allow fair constructive criticism and comment towards any government agency, private business or organization, and any legal citizen of the United States of America.



SEC. 1. SHORT TITLE.
This Resolution may be cited as the "The Fair Media Act."


SEC. 2. DEFINITIONS.

  • Defamation - Allegations or imputations that are slandering and injurious to another that may affect their trade, business, profession, or emotion and mental health.
  • Slander - A statement made with an ill will to spite or an intent to harm a person, persons, organization, business within regards to their trade, business, profession, health, or private life.
  • Constructive criticism - The judgement, evaluation, and suggestive input of the merits and faults of the work or actions of an individual or group.
  • Fair comment - Known in the US as common law defense that guarantees the freedom of the press to express statements on matters of public interest, as long as the statements are not made with ill will, spite, or with the intent to harm the other party.
  • The press - Any private, public, or self-employed journalist, and reporter. This includes all media organizations, networks, and government agencies making a press release.
  • Clear and present danger - Broadcasting or making the publication of any sensitive information that may cause or be a threat to national security, a threat to state security, or a threat to the Citizens of Los Santos.
  • Public interest - Anything related to politics, democracy, public concern, the safety and security of the citizens, and the nature of government itself.
  • Government authority/official - Any agency, or government official that is paid or funded by the state, federal, or city government.

SEC. 2. PROHIBITING SLANDER AND DEFAMATION OF CHARACTER BY THE PRESS.

  • We, the City Council of Los Santos, hereby declare that the press will be required to abide by all rules and regulations set forth by this bill. We the Council of the City of Los Santos hereby, and therefore require that the press will no longer be allowed to slander or make defamatory statements towards people, peoples, or a business, organization, and or any agency.


SEC. 3. ALLOWING CONSTRUCTIVE CRITICISM AND FAIR COMMENT BY THE PRESS.

  • We, the City Council of Los Santos, hereby declare that the press will be allowed and permitted to make any remarks towards a people, peoples, business, organization, or any agency. These remarks include; fair comment and constructive criticism. We the Council of the City of Los Santos hereby, and therefore deem that fair comment and constructive criticism do not fall under, "slander," and "defamation of character."


SEC. 4. THE PRESS, THE GOVERNMENT, AND LAW ENFORCEMENT AGENCIES ROLE IN THE FAIR MEDIA ACT.

  • We, the City Council of Los Santos, hereby declare that the press will be allowed and permitted to broadcast and make any publications they wish to so long as it is in accordance with The Fair Media Act. Broadcasts or publications made by the press, especially on matters of public interest shall in no way be forbidden unless such a broadcast or publication represents a clear and present danger. The press shall also be forced to follow all Federal Communications Commission (FCC) laws. Additionally, we hereby declare that it is illegal for any government authority to forbid the press from filming and taking pictures of on duty government officials performing their duties in order to write, broadcast or otherwise publish about matters of public interest. However, when the press is broadcasting or making a publication regarding matters of public interest, fair comment and criticism are allowed as long as a level of professionalism is maintained and it is clearly stated that the view is of the reporter, journalist, or the press themselves. Any publication or broadcast that is negative is allowed so long as there is a proper source to confirm it. The press will be allowed to report news from any location so long as they do not interfere with the situation. Law Enforcement Officials are responsible for setting up the roadblocks which is the border where the press may not cross unless permitted by the government agency. Along with that, the press may not forbid any government agency from making a public statement on the air. They may report that the government agency has no comment so long as that is what they were told.



SEC. 5. CONSEQUENCES AND ACTIONS TAKEN BY FAILING TO COMPLY WITH THIS ACT.

  • In the scenario that someone is found guilty by the Supreme Court of San Andreas and has indeed broken the laws of the Fair Media Law, the one charged will be required to pay a $50,000 fine, and to comply within reasonable requests made by the victim (The Supreme Court of Saxn Andreas will deem what is within a "reasonable request.") If the person or peoples are within a Media Organization, the Government of Los Santos will require that an external and internal investigation occurs to determine whether the people or peoples found guilty will be allowed to stay within their contract bounds. As well, the accused found guilty will have a record of breaking the law, and will not be able to have it removed from their records.
